Model and Property release information noted on this website is for general information purposes, only. Henry Westheim Photography bears no legal responsibility, or representation, for image noted as having a model and/or property release. Releases are held by, and the responsibility of, our Contributing Photographers. Henry Westheim Photography does not confirm or verify the release information Contributing Photographers note on their images upon submission. It is your responsibilityto comply with local/state/federal laws regarding releases for your specific license/licensing needs. Should your licensing need require a release, please contact us and we will contact the Contributing Photographer whose image(s) you wish to license requesting the appropriate release document. We will then e-mail you a copy of the release provided to us by our Contributing Photographer. Please note that this may take a few to several days, depending on the Contributing Photographer’s availability.

Definitions

To make the licensing of photography as simple and easy as possible, we have adapted the following definitions from The Picture Licensing Universal System (PLUS), http://www.useplus.com/glossary.asp. PLUS is a “worldwide coalition of leading companies, respected associations, and industry experts” that “clearly define and standardize the core aspects of image licensing and its management” (http://www.useplus.com/home.asp).

What is a release?

Model Release:

A document signed by the subject(or, if under age, the subject's guardian) to permit use of their likeness, voice or name for advertising or commercial purposes.

Property Release:

A document signed by the owner or controlling entity of property (a building, statue, or other object or area belonging to that owner or entity) that allows a photograph of that property to be published in advertising or other commercial use.

NOTE:While it is generally permissible for released photos to be used for any usage, exceptions may, and do, occur. Exceptions include the licensing of images for defamatory, sensitive and/or controversial usages. It is your legal responsibility to determine whether or not a release(s) is/are necessary, and to acquire that license, for your specific photo licensing need(s).
